03. Employment Based (workers & investors)

Workers (*Please note that except for the 1st category below, you must have an existing job offer):

Persons with extraordinary ability in the sciences, arts, education, business, or athletics (EB-1). You must have extensive documentation showing sustained national or international acclaim and recognition in your fields of expertise.

Outstanding professors and researchers (EB-1). You must have at least 3 years experience in teaching or research, and be recognized internationally.

Multinational managers or executives (EB-1). You must have been employed for at least 1 of the 3 preceding years by the overseas affiliate, parent, subsidiary, or branch of the US employer.

Professionals holding an advanced degree (EB-2). Your degree must be higher than a bachelor's. You can have a bachelor's degree and at least 5 years progressive experience in the profession.

Persons with exceptional ability in the sciences, arts, or business (EB-2). You are considered to have exceptional ability if you have a degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business.

Skilled workers (EB-3). You are a skilled worker if the job requires a minimum of 2 years training or work experience. The job must not be temporary or seasonal.

Unskilled workers (Other workers) (EB-3). You are an unskilled worker if you are capable of filling positions that require less than two years training or experience. The position must not be temporary or seasonal.

Investors​: A qualifying investment must, within two years, create full-time jobs for at least 10 US citizens, lawful permanent residents, or other immigrants authorized to work in the US, not including you, your spouse, and your children. You must invest, without borrowing, the following minimum qualifying capital dollar amounts in a qualifying commercial enterprise:

$1,000,000 (US); or
-
$500,000 (US) in a high-unemployment or rural area, considered a targeted employment area.
